Most likely yes, unless there is a certain match up which provides a breakpoint at level 40. This is unlikely. It will require more investment compared to a 15 attack rayquaza however.
Example given, my Kyogre with 12 attack IV had to be powered up until level 37.5 for Claydol, compared to 36 if it would had perfect attacking IV. A difference of 30 rare candy and about 25K stardust. Quite significant that is.
Anyway, the question is whether you would power up a rayquaza to level 40?
Note, however, that your Att 12 Kyogre at level 37.5 will likely do more DPS and more total damage in a raid than an Att 15 Kyogre at level 36. Sure, you're getting the same damage out of waterfall, but your Charged attack will be stronger, and you may take an extra hit and get off another attack before fainting.
I get what breakpoints do, but so many of you out there don't understand the limitations of only looking at breakpoints. Every power up is a step that improves the pokemon in battle; crossing a breakpoint is just a somewhat bigger step than the others.
Almost certainly it won't. The right question, however, is does it reach all breakpoints against relevant mon that a 15 attack one would. And that answer is almost certainly yes.
If you want to be completely cautious, wait until the 16th, and if you don't get a better Rayquaza (unlikely that you will, but here's hoping) then power this one up and don't look back. This of course assumes you want to power one up. If you decide that you need to invest dust and candy/rare candy to fight the Regis, do that instead.
