Ex Raid Eligibility

do you only get the chance for ex raid pass when you do legendary raids on ex raid eligible gyms or do lower tier raids also count??

Any raid at an eligible gym will count

In the old system it didn’t mater what level raid you did.... With this new system? Who knows?

I have to say I agree with the comment above yours. There's no reason you can't get an ex raid pass at an ex eligible gym regarding the levels of the bosses.

I got mine at a gym doing a 3 star raid, but then it got canceled.

I received my ex pass after completing a level 1 Dratini raid. I raided that that gym before, many times, and never got an ex pass from it while it was Mewtwo. Who knows what Niantic has borked up in the system.
