That stupid alert probably causes more accidents than it prevents. And there should also be an option for "I'm not even in a vehicle". I hate having to falsely claim that I'm a passenger when I'm just walking around.

If we knew for an absolute fact that it caused hundreds of deaths it still wouldn't be removed. They consider it a legal protection against actionable cases of negligence by players while driving. Such is the legal world

They could also just put a "I swear I won't play pogo and drive" prompt when you start the app, much like they do re trespassing.

Either way, give me an option to say that I'm not even in a car.

I'm sure if it was a violation they would have received a Cease and decist letter or be sued.

I would be okay with it if the warning only came up once when you reached a certain speed, but as it is it can pop up at any time. You can travel on a motorway for a time and suddenly it appears. Once it appeared as I was in a car that slowed down to park. Made no sense at all.
